These Terms & Conditions (“Terms”) govern your use of the website kiln-ink.com and the purchase of artworks and collectibles from Qingxuan International Trading Limited(“Kiln & Ink”, “we”, “us”). By accessing our website or placing an order, you agree to be bound by these Terms. Please read them carefully before proceeding.

1. About Us

Qingxuan International Trading Limited is a company incorporated in Hong Kong, operating as an online marketplace for contemporary Chinese art, including porcelain, calligraphy, printmaking, and heritage crafts. All artworks are authenticated and sourced directly from the artists or their authorised representatives.

2. Eligibility

You must be at least 18 years of age to use our website and make purchases. By using our services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding contract in your jurisdiction.

3. Artwork Listings and Pricing

• All prices are displayed in US Dollars (USD) unless otherwise indicated. Prices are inclusive of applicable taxes where required by law.
• We reserve the right to modify prices at any time without notice. The price at the time of your order confirmation is the price you will be charged.
• Product images are representative and displayed to the best of our ability. Minor variations in colour, glaze, or texture are inherent to handcrafted artworks and are not considered defects.
• Edition information (e.g. “Ed. 3 of 30”) refers to the specific numbered edition and is verified by the artist's signed certificate of authenticity.

4. Orders and Payment

• Placing an order constitutes an offer to purchase. We reserve the right to accept or reject any order, including cases of suspected fraud, payment failure, or stock unavailability.
• Payment is processed securely through Stripe. We accept major credit and debit cards (Visa, Mastercard, American Express) and other methods as displayed at checkout.
• Your order is confirmed when you receive an order confirmation email. Title to goods passes to you upon full payment and delivery.
• For limited edition and unique works, orders are processed on a first-come, first-served basis.

5. Auctions

• Participating in an auction constitutes a legally binding offer to purchase at the bid amount. The highest bid at auction close constitutes a binding contract between the winning bidder and Kiln & Ink.
• All bids are final. You may not retract a bid once placed.
• Winning bidders will be contacted within 24 hours of auction close. Payment must be completed within 5 business days of notification. Failure to pay may result in account suspension.
• Reserve prices (minimum sale prices) may apply. If a reserve is not met, the auction may close without a sale and we are under no obligation to sell.
• We reserve the right to cancel any auction at any time prior to close.

6. Shipping and Delivery

• We ship worldwide. Estimated delivery times are provided at checkout and are not guaranteed. Delays caused by customs, carrier disruptions, or force majeure are outside our control.
• All artworks are professionally packed and fully insured for their declared value during transit.
• International shipments may be subject to import duties, taxes, or customs fees in your country. These charges are your responsibility and are not included in our prices.
• Risk of loss passes to you upon delivery to the carrier.

7. Authenticity Guarantee

Every artwork sold by Kiln & Ink is accompanied by a Certificate of Authenticity signed by the artist or their authorised representative. This certificate documents the title, medium, dimensions, year of creation, and edition details. We stand behind the authenticity of every piece we sell. If you have reason to believe an artwork is not authentic, contact us within 12 months of purchase and we will investigate and, if the claim is upheld, provide a full refund.

8. Returns and Refunds

Please refer to our Refund Policy for full details on returns, exchanges, and refunds. Key points:

• Returns are accepted within 14 days of delivery for items in original, undamaged condition.
• Custom orders, framed works, and auction purchases are generally non-returnable.
• Refunds are processed within 10 business days of receiving the returned item.

9. Intellectual Property

All content on kiln-ink.com — including artwork images, text, logos, and design — is owned by Kiln & Ink or its artists and is protected by copyright and other intellectual property laws. Purchase of an artwork grants you ownership of the physical piece only; it does not transfer any copyright or reproduction rights unless explicitly stated in writing.

You may not reproduce, distribute, or commercially exploit any content from our website without prior written permission.

10. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to provide accurate, current, and complete information when creating an account and to update it as necessary.
• We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or place bad-faith bids.

11. Prohibited Conduct

You agree not to:

• Place fraudulent orders or bids
• Use automated tools to scrape or misuse our website
• Attempt to circumvent security or payment systems
• Impersonate any person or entity
• Use our platform for any unlawful purpose

12. Limitation of Liability

To the fullest extent permitted by applicable law, Kiln & Ink shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or the purchase of artworks. Our total liability for any claim arising out of or relating to these Terms or any purchase shall not exceed the amount you paid for the relevant order.

13. Dispute Resolution

We encourage you to contact us at hello@kiln-ink.com first if you have any complaint. We aim to resolve disputes amicably within 14 business days. If a resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong Special Administrative Region.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to its conflict of law principles.

15. Changes to These Terms

We reserve the right to update these Terms at any time. We will post the revised Terms on this page with an updated date. Your continued use of our website after changes are posted constitutes your acceptance of the revised Terms.
